WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND COVENANT NOT TO SUE

PLEASE READ THE ENTIRE DOCUMENT BEFORE SIGNING BELOW.

In consideration of being permitted to participate in any Sacramento Wheelmen Cycling Club (“Club”) sponsored bicycling activity, ride, event, or related activity (including travel, staging, instruction, refreshments, or gatherings; collectively, the “Activity”), I, on behalf of myself, my heirs, successors, assigns, estate, and anyone claiming through me, agree as follows:

1. Acknowledgment and Fitness. I understand the nature of cycling and represent that I am qualified, in good health, and in proper physical condition to participate safely. The Club and ride leaders make no representations regarding the safety or suitability of any route or my fitness. I acknowledge that the Activity occurs on public roads, bike lanes, multi-use trails, paths, and other public facilities, with hazards including traffic, weather, terrain, road conditions, animals, motor vehicles, other cyclists/pedestrians, and equipment failure. If I believe conditions are unsafe, I will immediately stop participating.

2. Assumption of Risk. I fully understand and voluntarily assume all risks of bicycling activities, known and unknown, including inherent risks and risks of serious bodily injury, permanent disability, paralysis, death, property damage, and economic loss. These risks may arise from my own actions or inactions, the actions of others, road/facility conditions, weather, third parties, equipment, or the ordinary negligence of any Releasee (defined below). I assume full responsibility for any injury, loss, or expense.

3. Release and Covenant Not to Sue. I hereby release, discharge, waive, and covenant not to sue the Club and its past, present, and future officers, directors, board members, ride leaders, volunteers, agents, employees, contractors, members, participants, sponsors, advertisers, and (if applicable) owners/lessors of premises used for the Activity, and their respective successors and assigns (collectively, “Releasees”), from any and all claims, liabilities, damages, losses, costs, and expenses (including attorneys’ fees), whether known or unknown, arising out of or related to my participation in the Activity, including claims based on ordinary negligence. This release does not extend to gross negligence or intentional misconduct.

4. Indemnification. I agree to defend, indemnify, and hold harmless the Releasees from and against any and all claims, liabilities, losses, damages, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of (a) my participation in the Activity, (b) any claim brought by or on my behalf, or (c) my breach of this Agreement.

5. Compliance with Laws, Safe Riding, E-Bike & Equipment Responsibility. I am solely responsible for riding safely, maintaining my own bicycle/e-bike in safe operating condition at all times, and obeying all applicable laws, ordinances, rules, and regulations (including speed limits, traffic laws, and bicycle/e-bike classification rules). The Club, ride leaders, and Releasees have no duty to inspect my bicycle or e-bike for safety, compliance, mechanical condition, or roadworthiness, and I assume all responsibility for any defects or issues. I acknowledge that rides may include portions of roads, trails, or areas that restrict or prohibit certain classes of e-bikes (e.g., Class 2 or 3) or ban e-bikes entirely. I have an ongoing responsibility to remain informed about current e-bike laws and trail-specific restrictions, to verify compliance of my equipment before participating, and to refrain from riding any restricted segments. Participation on any restricted trail, route, or area is entirely at my own risk.

6. Medical Authorization. I authorize Releasees to seek emergency medical treatment for me if I am unable to do so, and I agree to pay all costs. I release Releasees from liability related to such treatment.

7. Photo/Video Release. I grant the Club irrevocable permission to use my image, voice, or likeness from the Activity for any promotional or archival purpose without compensation.

8. Miscellaneous. This Agreement is governed by California law. It is binding and may be executed electronically. If any provision is unenforceable, the remainder remains in effect.
